Note 1 (Professional Fees):
Fixed Professional fee, stage wise (excluding disbursements) is computed unto filing of the admiralty suit at appropriate jurisdiction and making an application for order of arrest before the trial court under admiralty jurisdiction. This would include perusing your documents and papers; organising the same; correspondence with client/you for further clarifications; advising on ship arrest or release; preparation and drafting of the Plaint and ancillary pleadings to be filed in the High Court; filing in court the pleadings once approved by client/ you; attending conference with counsel and appearing for order of arrest; completing the process of arrest of the ship when ordered.
Note 2 (Disbursements/ Third Party Expenses):
Disbursements are third party expenses incurred. All third party expenses are on actual but is estimated for convenience of client and added to the fixed fee/ stage wise, if it is apprehended that the third party expenses is likely to escalate or de-escalate then client are informed accordingly.
Third party costs or disbursements wherever applicable would include travel and transport; photocopying; phones and faxes; experts and counsels; court and other departmental expenses; airfare, hotels and meals, video-conferencing; correspondent fees and expenses; court or institutional fees, stamping and registration; government, quasi-government or other fees; other actual expenses.
What we need from you
To enable us to estimate the fees and expenses for filing of the Admiralty suit and making an application for order of arrest of the ship at appropriate High Court having admiralty jurisdiction we request you to forward to us by email (in@brus.in) a detailed briefing note leading to the dispute (synopsis date wise) with supporting documents; all documents; all correspondences exchanged pertaining to the matter. A Power of Attorney (a format with instructions will be forwarded to you once we are satisfied that you have a case and can proceed under admiralty jurisdiction). Before forwarding any of the above we request you to email to us the name of the vessel and the name of the proposed plaintiff to enable us to run a conflict check and revert. The file will be attended by at least two qualified solicitor and/or advocate to ensure that quality service is delivered, at no extra cost.
After Ship is Arrested
Once the ship is arrested and should the matter not be settled out of court, our billing rates after the ship is arrested are computed on hourly basis + Disbursements on actual.
